Helen Daley conducted a successful prosecution on behalf of the Staff of the OSC in In the Matter of Carleton Lewis et al.  All three respondents were found to have committed fraud within the meaning of section 126.1 of the Securities Act, as well as unregistered trading and other securities offenses.  The case involved in excess of 25 million dollars and approximately 1,500 investors/victims.

Bill 168 – Amendments to Ontario’s Occupational Health & Safety Act

The provincial government has passed important amendments to the Occupational Health and Safety Act which will come into force on June 15, 2010.

The focus of these amendments is on violence and harassment in the workplace. Starting on June 15, 2010, employers must maintain workplace policies regarding violence and harassment in the workplace, and provide appropriate training to staff.

These policies should discuss appropriate reporting, managing complaints and risks associated with workplace violence, and also the circumstances under which the employer will summon immediate assistance to deal with a situation of actual or imminent violence in the workplace. Employers must also do a “risk assessment” of their workplace, to determine if their operations are susceptible to acts of violence.
